Applications for labor pensions and social benefits

The procedure for determining, calculating, transferring and receiving pensions and social benefits is determined by the relevant executive authority. These issues are regulated by the Laws of the Azerbaijan Republic “On labor pensions” and “On social benefits”.
Benefits are determined and paid by the relevant executive authorities at the place of residence of the person. Electronic services related to the provision of benefits are provided through the centralized electronic information system of the relevant executive authority. The date of filing an application for benefits is the date of filing documents confirming age, disability, loss of the head of the family and other persons.
The decision to assign benefits is made by the relevant executive authority within 10 days from the date of appeal. According to the Law on Social Benefits, if a decision has been made to refuse to grant benefits, the relevant executive authorities officially notify the person who has applied for it within 5 days, indicating the reasons for the refusal. The decision to refuse to grant benefits may be appealed in an administrative and judicial order.
A retirement pension is assigned by the relevant executive authority that administers in the field of compulsory state social insurance, pensions and pension allowances at the permanent residence of the person (applicant), and to refugees and internally displaced persons at the place of settlement. The appointment of a retirement pension to citizens of Azerbaijan permanently residing abroad is carried out by the relevant executive authority
It should be noted that the decision of the authority appointing the retirement pension may be appealed in an administrative and judicial order.
Retirement pension
As stated in the Law on Labor Pensions, men over the age of 63 and women over the age of 60 have the right to a retirement pension if the pension capital registered in the insurance part of an individual account allows pension provision not less than the minimum labor amount pensions, then regardless of the length of service, and if such a pension does not allow, then if there is at least 25 years of service.
The age limit for men from July 1, 2017 to July 1, 2021 provided for in Section 7 of the Law “On Labor Pensions”, the age limit for women from July 1, 2017 to July 1, 2027 is increased annually by six months.
Women who have given birth to five or more children and raised them up to eight years of age and have at least 10 years of insurance experience are entitled to an old-age labor pension with a decrease in the age limit by 1 year for each child under the conditions corresponding to Section 7 of the Labor Law pensions.
Employees of the prosecutor's office who served in the prosecution authorities, justice officials, persons with pituitary dwarfism (midgets), and disproportionate dwarfs are entitled to receive an old-age retirement pension in positions related to work in the flight and flight test staff of civil aviation.
Disability Pension
A disability pension is granted in connection with a disability due to a mental or physical disorder resulting from an illness or injury to the insured. Disability groups and the causes of disability or limited health capabilities up to 18 years of age, as well as the time of their onset, are determined by the relevant executive authority in accordance with the law.
A disability pension is granted to a group of Level I invalids in the presence of a 4-month insurance period for each full year of the working-age period, provided that his/her insurance period is at least 5 years in general. A retirement pension is granted to invalids of groups II and III if there is an insurance experience, provided that the pension capital registered in the insurance part of the individual account allows pension coverage not less than the minimum amount of a labor pension.
Disabled people from the military are divided into the following categories:
- Disabled persons of war - in the event of disability as a result of injury (injury, injury, contusion) in the performance of their military duties (official duties), or as a result of illness due to being at the front or performing a peacekeeping mission in countries where military operations are taking place;
- Other military invalids - in case of disability as a result of injury (injury, injury, contusion) received due to an accident not related to the performance of military duties (official duties), or illness not related to being at the front or performing peacekeeping mission in countries where fighting is taking place.
- Disabled persons of war are persons who have undergone active military (alternative) military service if the disability occurred as a result of injury, contusion, injury sustained while performing active military or alternative military service, or as a result of illness associated with being at the front or performing military duty host countries
Pension for loss of the family head
The following members of the family of the deceased or deceased breadwinner who was dependent on him have the right to a labor pension in case of loss of the breadwinner:
- Children of deceased or deceased persons;
- Under the age of 18;
- A disabled person over 18 years of age, whose limited health abilities were established before the age of 18;
- Full-time students of educational institutions, but at most until they reach 23 years of age.
If for the non-able family members the total amount of labor pensions is less than the minimum amount of the labor pension, then they are paid this amount.
In the absence of heirs of the insured or labor pensioner, the funded part of the retirement pension, funds from his individual account and funds not received for the funded part of the retirement pension belong to the budget revenues of the relevant executive authority.
