Obtaining a temporary or permanent residency permit
ApIications for immigration, temporary residence and advises on visa procedures are the most important issues in the field of migration. These issues are resolved in the manner prescribed by law.
In recent years, the State Migration Service has taken a number of important steps to strengthen bilateral and multilateral relations. Thus, the number of foreigners and stateless persons arriving in the country for temporary or permanent residence has increased.
Temporary residence permit (permit)
Foreigners and stateless persons must obtain a temporary residence permit in the territory of the Republic of Azerbaijan. This permission is issued by the State Migration Service of the Republic of Azerbaijan. When these persons are allowed to reside in the country, the State Migration Service issues a temporary residence permit.
A permit for temporary residence in the territory of the Republic of Azerbaijan is a document giving a foreigner and stateless person the right to temporary residence in the territory of the country, to leave the Republic of Azerbaijan and return to the Republic of Azerbaijan without a visa during the validity period, as well as identifying the specified persons in the country and their registration at the place of residence.
In case of change of information in the identification documents of foreigners and stateless persons or loss of a permit, they must inform the relevant executive authority within 10 working days and submit a request for re-issuing or canceling the permit.
According to the Law “On State Duty”, applications from foreigners and stateless persons for a temporary residence permit in the territory of the Republic of Azerbaijan are considered in accordance with the amount of state duty paid within the time period established by law.
Cases of issuing temporary residence permits to foreigners and stateless persons in the territory of the Republic of Azerbaijan
Cases of issuing a temporary residence permit to foreigners and stateless persons on the territory of the Republic of Azerbaijan are listed in Article 45 of the Migration Code:
- being in close family relations with a citizen of the Republic of Azerbaijan;
- investments in the country's economy in the amount of not less than 500,000 manats;
- possession in the territory of the Azerbaijan Republic of real estate worth at least 100,000 manats;
- when investing funds in the amount of not less than 100,000 manats on the basis of a fixed-term deposit agreement with banks operating in the Azerbaijan Republic;
- obtaining a work permit for engaging in paid labor activity on the territory of the Azerbaijan Republic in the manner prescribed by this Code;
- obtaining education in higher and secondary special educational institutions in full-time and in general educational institutions;
- engaging in professional religious activity in religious structures taken for state registration;
- upon recognition of a person as a victim of human trafficking;
- when assisting criminal prosecution authorities, etc.
Documents required for issuing (extending the term) of a temporary residence permit for foreigners and stateless persons in the territory of the Azerbaijan Republic
Article 46 of the Migration Code lists the documents required for the issue (extension) of a temporary residence permit for foreigners and stateless persons on the territory of the Republic of Azerbaijan. To obtain (extend the term) a temporary residence permit in the territory of the Azerbaijan Republic, foreigners and stateless persons must submit the following documents:
- Application form, a sample of which is approved by the relevant executive authority;
- Passport or other documents for crossing the border (the validity of a passport or other document for crossing the border must be at least three months longer than the expiration of the temporary residence permit);
- A copy of the birth certificate or other document equivalent to it (for persons under the age of 18 and without a passport), certified by a notary;
- A document confirming the presence of circumstances in a notarial order or an equivalent procedure to it that is the basis for the issuance of a temporary residence permit;
- A certificate stating that he is not a carrier of the disease virus provided for in the list of dangerous infectious diseases approved by the relevant executive authority;
- A copy of the document giving the right to temporary residence or temporary residence in the territory of the Azerbaijan Republic;
- A substantiated application of an enterprise, institution and organization inviting foreigners and stateless persons who are highly qualified specialists in the economic, industrial, military, scientific, cultural, sports and other fields to the Republic of Azerbaijan;
- Two photographs measuring 3.5 x 4.4 cm;
- The document of the dwelling where it will be registered (extract from the state register of real estate on state registration of property rights, warrant, lease (rental) agreement or other document provided for in the legislation of the Azerbaijan Republic);
- Application of a person providing housing to a foreigner or stateless person (unless the foreigner or stateless person has his own living space);
- A copy of the identity document of the person providing the accommodation to the foreigner or stateless person (except in cases where the foreigner or stateless person has his own accommodation);
- State duty payment document;
- When issuing a temporary residence permit to foreigners and stateless persons, a document on the payment of the state duty is also issued.
A temporary residence permit for foreigners and stateless persons may be granted for a period of not more than one year and may be extended, if applicable, for a period of not more than 2 years.
Temporary Visa
According to the legislation, the length of stay of foreigners and stateless persons arriving in the Republic of Azerbaijan depends on the length of stay in the country. The stay of foreigners and stateless persons arriving in the Republic of Azerbaijan without a visa is 90 days. However, in cases stipulated by international treaties to which the Republic of Azerbaijan is a party, this period may be longer.
According to article 20 of the Migration Code, if at the end of the specified period the period of temporary stay of foreigners or stateless persons in the country has not been extended, they have not been issued a temporary residence permit, or they have not received an application to extend the temporary stay or to issue a temporary permit residence, they must leave the territory of the Republic of Azerbaijan.
Permanent Residence Permit
Foreigners and stateless persons who have continuously resided in the territory of Azerbaijan with a temporary residence permit for the last two years may apply for a permanent residency in the territory of the Republic of Azerbaijan.
Immigrants are considered foreigners or stateless persons who are allowed to reside permanently in the country in accordance with the law. Immigrant status is granted to these persons for a period of five years and may be extended for another five years. The number of extensions is not limited.
Permanent residence in the territory of Azerbaijan is given to foreigners and stateless persons by the relevant executive authority. When issuing a permit to foreigners and stateless persons for permanent residence in the territory of the Azerbaijan Republic, the indicated executive body shall issue a permit for permanent residence in the territory of the Azerbaijan Republic.
Foreigners and stateless persons, if there are circumstances for issuing a permit for permanent residence in the Azerbaijan Republic, at least 3 months before the expiration of the permit for permanent residence in the territory of the Republic of Azerbaijan, must apply to the relevant executive authority for permission.
